INTRODUCTION
These Terms and Conditions written on this page shall manage your use of 'Chefs Without Limits', the 'Company', its services, website and Apps, or the 'System', accessible at chefswithoutlimits.com.
These Terms will be applied fully and affect to your use of this System. By using this System, you agreed to accept all terms and conditions written in here. You must not use this System if you disagree with any of these Terms and Conditions.
NO WARRANTIES
This System is provided “as is,” with all faults, and the Company expresses no representations or warranties, of any kind related to this System or the materials contained within this System. Also, nothing contained on this System shall be interpreted as advising you.
RESTRICTIONS
You are specifically restricted from all of the following:
publishing any System material in any other media;
selling, sublicensing and/or otherwise commercializing any System material;
publicly performing and/or showing any System material;
using this System in any way that is or may be damaging to this System;
using this System in any way that impacts user access to this System;
using this System contrary to applicable laws and regulations, or in any way may cause harm to the System, or to any person or business entity;
engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this System;
using this System to engage in any advertising or marketing.
Certain areas of this System are restricted from being accessed by you and the Company may further restrict access by you to any areas of this System, at any time, in absolute discretion. Any user ID and password you may have for this System are confidential and you must maintain confidentiality as well.
INTELLECTUAL PROPERTY RIGHTS
Other than the content you own, under these Terms, the Company owns all the intellectual property rights and materials contained in this System.
PAYMENT TERMS
Any fees that the Company may charge you for the System or Services, are due immediately and are non-refundable.
The Company may change the fees for Services, as we deem necessary for our business.
The service provider, the Company, demands the payment immediately after the delivery of the product or service.
It is Payable on Receipt. In the absence of adherence to the term, the deal or delivery is taken as canceled or void.
There are no sign up or registration fees & there are no monthly subscription fees. The currently effective Fee as of May 1st, 2022 is 5% on final orders only. This excludes the Stripe.com payment processing fee of approximately 2.9% & $0.30.
You will not be charged any fees until you make a sale from your venue through the Chefs system. This way you can setup & present your menu & pay no costs until a purchase through the system is made by one of your customers or clients.
INDEMNIFICATION
You hereby indemnify to the fullest extent the Company from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.
ASSIGNMENT
The Company is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.
